Process for Probating a Will
|
1. Original will and a copy of the Death Certificate
|
2. If original witnesses are deceased or unavailable, some one must accompany family and verify signature on will.
|
3. Executrix/ executor must be present to probate.
|
4. If will is executed with husband/wife survival, will is not necessarily subject to porbate.
|
6. An appointment in necessary to probate the Will.
|
5. If there are one or more objects-that is car, home, etc.--in deceased name, Will must be probated.
|
7. Ten (10) days must pass after death before the Will can be probated-- that is on the 11th day.
|
8. The Surrogates Office is open from 8:45 to 4 PM Monday thru Friday.
|
9. Minimum fee of $100.00 for two (2) pages (ea. additional page $5.00) that will entitle you to one free copy of Surrogate paper. Each additional copy of Surrogate paper is $ 5.00
|
10. An additional fee may be charged if original witnesses have moved from state and must be notified for verification of signatures.
